My boyfriend is a citizen of Greece living in the USA (legally). What happens if we marry?
If we marry and have children, what citizenship issues may arise for us? Also, we would like to open a joint checking/savings account and seem to be running into trouble. My boyfriend is not employed in the US, but receives his income from abroad and pays taxes abroad. Thank you for any help or advice you can give.

If he lives here full time he is liable to pay US taxes no matter where his income is derived. If you marry you will have to file jointly, if he is a legal alien I assume he has a Green Card and a Social Security number? If not he needs to apply for one. Children born in the US are American.

As a green card holder he is still supposed to file a tax return each and every yr, whether he has actual earned income to report or not. Once married you do NOT have to file jointly. You can still continue to file separately, which may be the better option so you don't go over the limit and have to start paying (depending on his income of course) There is no law written that couples with one immigrant have to file a join return. The children will of course be American citizens. I am not sure how it would work for the Greek end of it. Could be they would be dual citizens. If your husband has a valid green card, I do not understand why he is having trouble opening a bank account. When my husband first got his green card, before he started working, we opened one at RBC Centura..then a few months later at BoA. I would ask what the issue is. Your husband would be eligible to apply for US citizenship 3 yrs after marriage. Good luck Belle

After you marry, you can apply to adjust his status (become a permanent resident). Once he has obtained the permanent residency (green card) he is entitled to a social security number which he can use to open a bank account. Most banks do not allow to open an account without a ss#. There should be no problem for him to adjust his status.
